Michael Jordan Tells Court He Felt No Fear of Nascar in Legal Battle

The basketball icon, introducing himself formally in a federal courtroom on Friday, stated that his competitive side and status as a newcomer motivated his push for 23XI Racing to confront Nascar over perceived violations of antitrust rules.

Team Investment and a Will to Win

Jordan shared financial and corporate details of his racing venture, revealing he put in $40 million of his personal wealth into the Cup Series operation co-founded with partner Polk and longtime driver Denny Hamlin.

“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “As a newcomer, I had no fear. I believed I could take on Nascar as a whole. From my perspective, the sport it needed to be looked at through a new lens.”

The Core Dispute: Franchise System and Contract Pressure

At issue is the expiration of a 2016 agreement where Nascar provided each team a “charter”. The concept is similar to other professional sports with independent franchises, like the NBA’s Hornets or the Carolina Panthers. This deal was due to end in 2024 when Nascar insisted on charter membership renewals.

Jordan was on the witness stand for about sixty minutes and exited the courthouse to a media frenzy, with fans and media clamoring for a glimpse or a picture of the sports legend.

Leading the Legal Charge

Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to change a operating model Jordan said is unlawful to maintain excessive control.

At issue for Jordan and Heather Gibbs, who preceded Jordan, are events from last September. Heather Gibbs’ Testimony

Gibbs described her push for indefinite franchises, submitted in a formal letter to Nascar. She said the pressure of the signature deadline was problematic.

According to her, the team founder first tried to call and talk Nascar out of demanding signatures, but Nascar’s leader declined the request.

“Don’t do this to us,” Gibbs recounted Joe Gibbs told Nascar’s executives. The response was, “Whether I have 20 charters, that’s what I have. If I have 30, I have 30.”
