US Court Mandates Freedom of Kilmar Abrego Garcia from ICE Detention
A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks legal authority.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.
The situation originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. Following his return to the United States to face human smuggling allegations, he was held in immigration detention.
In her order, the judge noted that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
Context of the Case
The legal proceedings involve conflicting assertions. While the former administration argues that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this allegation.
He has also pleaded not guilty to the conspiracy counts, which are part of a ongoing criminal case in the state of Tennessee.
Conditions of Freedom
The court, who was hearing his challenge to removal in a Maryland district court, determined that he must now adhere to the terms of his bond from jail in Tennessee. This decision shifts his monitoring to the jurisdiction handling his criminal case.
This decision marks a significant turn in a complex legal case involving allegations of wrongful detention and disputed criminal affiliations.
